At Schaet and Hoffman we take great pride
in our success. For your review we have listed a sampling of our
most recent victories in court. While every case is different, the
same issues continually rear up. Maybe the facts below are the same
as those that you encountered. This page is continually updated.
*Charge: Driving Under the Influence
Facts: After arrest for driving under the
influence, the police draw blood at a hospital. The results are
.179, .188. The officer also charges the client with resisting an
officer without violence for refusing to be handcuffed.
Results: After successfully arguing a motion
to suppress, the Judge ruled that the charge of resisting an officer
without violence is suppressed. Additionally, the Judge ruled that
the blood result is inadmissible.
*Charge: Possession of marijuana
Facts: The police follow the client for 3
miles and cite him for an obscure traffic violation. After making
contact with the client the officer uncovers marijuana.
Results: We filed a motion to suppress the
stop based upon an illegal search and seizure. The Judge ruled that
the officer did not have probable cause to stop the client. Case
dismissed.
*Charge: Failure to Use Due Care Resulting
in Fatality
Facts: At a scene of a fatal traffic accident
the police charge the client with careless driving resulting in
a fatality.
Results: After trial, the Judge ruled
that the State did not present enough evidence to support a conviction.
Case dismissed.
